Did Rendall & Rittner commit criminal offenses related to service charges?

Supplying information on how the service charge is spent is a legal requirement.

Summary: Under section S.22 of the Landlord and Tenant Act 1985, leaseholders (Mallard House residents in this case) have the right to see information on the service charge spent. The managing agent (in this case Rendall & Rittner), should respond to the request within 21 days.

If the managing agent (Rendall and Rittner) fails to respond to a request for Scharge information from a leaseholder, it is treated as a criminal offence and can result in a fine for Rendall and Rittner.

The emails sent to Rendall and Rittner (below) confirm that R&R not only failed to respond but also harassed the leaseholder from Mallard House SW6 London over the disputed Service charges & kept sending threatening emails/letters with unjustified demands from 5th July 2018 till now 2024.

Then R&R appointed J B Leitch solicitors (which has one of the worst ratings in the UK) who sent threatening letters stating many false statements.

Hello Ms Simpson,
Thank for your email and clarity. I have one more query, please.

I have attached the account from R&R Year Ended 31 December 2016, for BLOCK J (Rocket, Mallard, Stephenson, Stanier, Orient), TOTAL SERVICE CHARGE EXPENDITURE (PAGE 43 of PDF) for whole block for whole year is £81,840 AND the Scharge which you have requested from Mallard house resident for 2017-18 is also roughly £80K for whole year ending 31st March 2018.

Could you please help explain HOW the £81840 (2016-17) for whole block J which consist of (Rocket, Mallard, Stephenson, Stanier, Orient) translate into roughly £80K for Mallard House only in 2017-18???

If you kindly explain this difference by tomorrow (or at the earliest) and help explain how actual numbers add up, I would be happy to pay by tomorrow itself as this is really not worth my time.

(1)It CLEARLY stated that for Whole year 2016, the total S Charge for WHOLE BLOCK J (Rocket, Mallard, Stephenson, Stanier, Orient), £81,840
and after adding reserve funds around £93000. Now point is you are asking roughly similar amount from Mallard House ONLY for the year 2017??? how does that amount for WHOLE block J, translate into SCh for Mallard House only???

(2)Are we paying service charge for others houses of BLOCK J as well??? and What percentage of £93000, should Mallard house pay???

I haven’t received answer to my simple queries despite my repeated emails regarding service charge (email below)but got frequent reminder for payment for the same. I find it unprofessional!!!

(1)As a courtesy, I have paid yesterday full service charge amount for the year 2017-18 screenshot below. Please confirm the receipt for the same.

Respected Sir,
My name is Subodh Gupta resident of Flat 35 Mallard House, Station Court, SW62BF London. I would like to bring to your kind attention 2 issues, delayed for many years at your end.

(1) NO 1 PRIORITY: Fire Escape (Mallard House)
Mallard House building is closed from all three sides and only one entry door/exit door at GFloor with no fire escape door? So if there is a fire on the 1st/2nd floor, all the residents on the upper floor are like sitting duck especially if they live on the backside of the building as no fire brigade can reach there.

SOLUTION: The one possible solution I see is the door to the roof from where one can easily escape to the other buildings/hotel exit either side. But the door to the roof is kept closed (I don’t know under whose direction) even though it has high enough parapet wall more than 1 meter and exit possible??? Now our MH association has raised this issue for the last 15 years but no action has been taken so far at your end???

(1a)Possible solution I see: Either that roof door shall be open for the Mallard House residents as other buildings have roof garden so why our roof is not open OR alternatively every resident must be given a key to the roof door so in case of fire, emergency one can escape.

Alternatively, kindly suggest which of your organization would be ready to take responsibility in case of fire as there is no fire exit door except the entrance???

(1b)Regarding the recent front door inspection of each flat in Mhouse, there are doubts if the original door fitted good for fire safety?
How come MHbuilding got a fire safety certificate in the first place? and also how come from the last 16 years it has been given ok status for front doors but now it seems NOT ok?

(2)SERVICE CHARGE
MHouse association has been requesting for the last few years for the ACTUAL INVOICES on the basis of which Service charge demand is raised under section 10 to MH leaseholders/residents.

Reason: We noticed many service expenses charged to MH residents in the past which were never been provided to MH residents in the first place. I leave this for our Mhouse association to follow up. I only request you to please provide the requested invoices/information/accounts by our Mhouse association at the earliest so service charge dispute can be resolved asap, once for all.

Your response on 2 of yours incorrect misleading statements and another fire safety query is still pending. You have send me SCharge bill instead of fire safety response. I would like Scharge issue also to be resolved asap.

Michael, MHRA find out that R&R overcharged around 40,000 pounds to MHRA for the services which were not provided in the first place???

(1)Can you please confirm how this mistake happened at your end for many years ? (2)Can you confirm that there is no other mistakes as above of overcharging MHRA in your accounts?

(3)Can you please confirm that you have deducted the extra money you overcharged around 40,000 pounds from any outstanding scharge bill to the residents. As I would like any overcharging by yourself be deducted from any bill you send us.

(4)Kindly send me a statement of all the charges (based on ACTUAL INVOICES) from the point you have taken over from A2D till today date AND all the payment you have received from us so I can sort out any outstanding payment straight away. Also how you workout our scharge for flat 35 from total. I need to ask all these queries because of overcharging at your end.

Please answer specific to the above queries raised so nobody time wasted further.

Its unfortunate that despite 4 months has gone and my queries are still pending at your end in regards to both Scharge and Fire Escape Door. Instead of responding to my queries, you have again send me Scharge demand letter?

Scharge issue Mallard House:
This is to inform you that I am exercising my “Summary of Tenant’s rights and obligation” in relation to variable service charges which is set out on “summary clause 10”. This is to inform you that I dispute charges under Estate 1A and also J block as these charges don’t correspond to my lease.

I have requested yourself in the past that please provide the requested actual invoices/accounts specific to Mallard House to our MH association so service charge dispute can be resolved asap, once for all at the earliest but unfortunately that hasn’t been the case.

Action point:
Although you have not provided requested information related to Scharge to me nor bother to reply my queries, still I will pay 1500 GBP today in good faith hoping RR would make an effort to resolve this issue at the earliest and provide actual accounts/records related to MHouse.

Fire Escape Door:
I haven’t received any response on my previous email dated 13th Oct 2020 related to Fire Escape Door (email below).

Action point:
We as a resident of MHouse must have access to roof door and unfortunately all the reasons provided by yourself on behalf of RR were incorrect. I would like the Schrage issue related to Mhouse to be resolved asap as it pending a long time at your end, but:

(1) It is unfortunate that for around 3 years there is no effort on behalf of RR to resolve the service charge queries from Mallard House association and no response to Schrage queries raised by myself (unanswered email below).
RR sends Schrage bill but doesn’t bother to reply to the Schrage queries. How ethical is that? (Kindly refer to the email below)

(2) The response from RR about roof access to the Mhouse resident turned out to be factually incorrect and after that no response on that. (Please refer to the email and also the link below).

Good afternoon

Your team keep ignoring MH residents’ legitimate concerns for years. How is that fair? I have raised 2 of the most important issues which will actually help RR in case of Fire eventuality.

(1) Roof Keys to Mhouse.

Solution: This issue can be easily solved if you simply hand over the keys to MH residents.

I have explained to you several times that Mhouse is closed from all the 3 sides and the fire brigade can’t reach the block of flats at the backside in case of fire, there is no way the resident’s floor can escape if a fire starts in any of lower floor and we don’t have any SEPERATE fire exit.

Your team provided 2 misleading reasons for not handing over the roof keys, and BOTH of your reasons came out to be FACTUALLY INCORRECT??? and after that, your team went totally silent. Please refer to the email below.

(2) Disputed Service Charge issue

In the past, there were incidences where the Mhouse association found evidence of being overcharged by RR? I have asked several times:

(2a) Can you ensure and confirm there is no more overcharging (ie we being charged for services or repairs not provided or done at Mallard House) Your team is again silent on this point??? Interesting isn’t it?

(2b) MH resident association is asking several questions related to disputed service charges for several years and again they have not been provided.

Kindly make an effort to resolve the disputed issue with MH association team members.

(P.S. To be fair on my side I have paid several payments of service charges to RR in good faith hoping your team would resolve the disputed SC issue and even set up a STANDING ORDER for the SCharge with the monthly payment, dt 10th of each month starting this month (pro-rata £1500 per year REF: GUPTA075).

MH residents are not the only ones who are dissatisfied with your services. 200 extremely dissatisfied Residents from 10 developments have written open letter to R&R. You are welcome to do a quick google search.

Also please note: Your team keeps sending unjustified threatening letters instead of resolving the disputed issues which is kind of kiddish. So kindly stop sending any more letters until you resolve the issues with MH association unless you really want to escalate the issues.

Please note it is very easy to put this issue in the whole UK National media with so many residents’ associations unsatisfied with R&R unethical practices. I would like to state here last time that I will not be responsible for any brand damage as I have provided enough time frame and if issues continue to stay unresolved. (I have a long list of discrepancies at the RR end that I can point out from dog menace to ….but at the moment above 2 disputed issues needs to be resolved) This is for your information.
